Warranty coverage terms & conditions.

1. Warranty Coverage: A&R Contractors & Builders, LLC warrants that all work performed under the Contract will be free from defects in workmanship by the Contractor for a period of 1 year from the date of substantial completion of the project ("Warranty Period").

2. Exclusions from Warranty:

   • This Warranty does not cover:

     • Defects or damages caused by:

       1. Normal wear and tear.

       2. Client negligence, misuse, or failure to maintain the property as advised.

       3. Acts of God, natural disasters, or extreme weather conditions.

       4. Modifications, alterations, or repairs made by anyone other than the Contractor or authorized representatives.

   • Defects in materials, fixtures, or equipment provided by the Client or third parties.

   • Variations in natural materials (e.g., wood grain, stone, etc.) or minor aesthetic imperfections not affecting performance.

3. Warranty Claims: To make a claim under this Warranty, the Client must:

   • Notify the Contractor in writing of the defect within the Warranty Period.

   • Provide details of the defect, including photographs.

   • Allow the Contractor reasonable access to inspect and address the issue.

   • Failure to provide timely notice or prevent access may void the Warranty for the specific claim.

4. Remedies Under the Warranty: If the Contractor determines that a defect covered under this Warranty exists, the Contractor will, at its discretion:

   • Repair the defective work; or 

   • Replace the material at owners expense or if material warranted by 3rd party

5. This Warranty does not include reimbursement for costs incurred by the Client for third-party repairs, replacements, or other solutions undertaken without the Contractor’s written approval.

6. Limitations of Liability: 

   • The Contractor’s liability is limited to the original contract value.

   • The Contractor is not responsible for indirect, incidental, or consequential damages, including but not limited to loss of use, lost revenue, or additional expenses.

   • The Client’s sole remedy under this Warranty is repair or replacement as specified above.

7. Termination of Warranty: This Warranty is null and void if:

   1. The Client fails to pay any outstanding balances under the Contract.

   2. The Client or a third party alters or modifies the work performed by the Contractor without written authorization.

8. Third-Party Warranties: Products or materials installed under the Contract may carry manufacturer warranties. Claims related to such warranties must be made directly to the manufacturer. The Contractor assumes no responsibility for defects or failures covered by manufacturer warranties.

9. Governing Law: This Warranty is governed by the laws of the State of New Jersey. Any disputes arising under this Warranty will be resolved in accordance with the dispute resolution terms in the Contract.

10. Force Majeure: The Contractor is not liable for delays or damages caused by events beyond its reasonable control, including but not limited to natural disasters, acts of war, or labor strikes.

11. Entire Agreement: This Warranty constitutes the entire agreement regarding warranty coverage for the work performed under the Contract. No oral or written representations, except those contained herein, shall modify this Warranty.
